Terms of Service

StaceyChat lets a business connect WhatsApp and Telegram, teach an AI assistant (“Stacey”) about the business in plain words, and have her draft or send replies to customers. StaceyChat is in beta: features may change, and it may sometimes be unavailable or not work as described.

• You must be at least 18 and give accurate information.
• Keep your password safe. You are responsible for what happens under your account and for the team members you invite and the roles you give them.
• Tell us straight away at petergrant01@gmail.com if you think your account has been misused.

StaceyChat uses the Google Gemini or Anthropic Claude key your business adds. You are responsible for that key, for your agreement with that provider, and for any charges it makes.

Stacey's replies are written by an AI model. We build in checks (for example, a reply stating a price, time or link that is not in your notes is held for a person), but AI can still be wrong, incomplete or inappropriate. You are responsible for what you teach Stacey, for choosing whether she drafts or sends replies by herself, and for the replies sent from your channels. Check her work, especially before switching on automatic replies.

StaceyChat connects to WhatsApp as a linked device and not through WhatsApp's official Business Platform. The WhatsApp connection is designed to help you test WhatsApp connectivity on a test number only. WhatsApp may restrict or ban a number used this way. We have had no reports of this happening with StaceyChat and we build in pacing and limits to keep the risk low, but those safeguards are best effort and we cannot guarantee any outcome.

By connecting a WhatsApp number you accept our WhatsApp notice, which forms part of these terms, and you do so at your own risk. We are not liable for any restriction, suspension or ban of a number or for any loss that follows from one.

Telegram is connected through Telegram's official Bot API, and you must follow Telegram's terms when you use it.

You must not use StaceyChat to:

• send spam, unsolicited, bulk or marketing messages, or messages to people who have not contacted you or agreed to hear from you;
• break the law or the terms of WhatsApp, Telegram, Google, your AI provider or any other service you connect;
• harass, deceive or harm anyone, or send unlawful, hateful, violent or sexually explicit content;
• collect or handle personal information without a lawful basis, or handle especially sensitive information (such as health or payment card details) through Stacey;
• get into accounts, systems or data you are not allowed to, or interfere with, overload, probe or reverse-engineer StaceyChat;
• resell StaceyChat, or use it to build a competing service.

We may suspend or close an account, or disconnect a channel, if we reasonably believe these terms are being broken or the service is being put at risk.

You keep ownership of everything you and your customers put into StaceyChat. You give us permission to store, process and transmit it only as needed to provide StaceyChat to you. We do not use it to train AI models.

For your customers' personal information, you are the controller and we act as your processor, only on your instructions as set out in these terms and our Privacy Policy. You are responsible for having a lawful basis to message your customers and for telling them how you use their information, including that replies may be written by an AI.

StaceyChat is free during the beta. If we introduce charges, we will tell you in advance and you can choose whether to continue. Charges from your AI provider are between you and that provider.

You can stop using StaceyChat at any time and ask us to close your account by writing to petergrant01@gmail.com. We may end or suspend the service, or any part of it, with reasonable notice, or straight away where needed for security, legal reasons or a serious breach of these terms. When an account is closed, we delete its data as set out in our Privacy Policy.

StaceyChat is provided “as is” and “as available”. To the fullest extent the law allows, we make no promises that it will be uninterrupted, error-free, or suitable for any particular purpose, that any message will be delivered, or that the services it connects to (WhatsApp, Telegram, Google, AI providers) will keep working with it.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow to be limited.

Subject to that, to the fullest extent the law allows:

• we are not liable for any loss of profit, revenue, business, customers, goodwill or data, or for any indirect or consequential loss;
• we are not liable for replies written by the AI, for actions taken by WhatsApp, Telegram, Google or your AI provider (including a restriction or ban of a number or account), or for any loss that follows from them;
• our total liability to you for all claims in any 12 months is limited to the greater of the amount you paid us in that period and £100.

You agree to cover our reasonable losses and costs from any claim by a third party arising from your content, the messages sent from your channels, or your breach of these terms or of another service's terms.

We may update these terms. We will change the date at the top and tell account owners by email or in the app before a significant change takes effect. If you keep using StaceyChat after that, the new terms apply.

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that if you are a consumer you may also bring a claim in the courts where you live.
